Why this New Guideline ?
When the GST system was first implemented in India, Registration Certificates (commonly known as RC) were issued without much restriction. Some individuals took advantage of this and started multiple fake businesses, engaging in GST fraud. To regulate such malpractices, the Central Board of Indirect Taxes and Customs (CBIC) has introduced several new guidelines.
Key points from the new guidelines:
- These guidelines aim to prevent fraudulent registrations and protect genuine applicants during the registration process.
If the business is operated from an owned property, copies of property tax receipts/municipal permission documents and electricity bills in the owner’s name must be submitted.
If the business premises are rented, a rental/lease agreement copy, along with property tax receipts, municipal permission documents, and electricity bills are required. However, the landlord’s PAN card, Aadhaar card, or photograph should not be asked for.
If the rental/lease agreement is not registered, then at least one identity document of the property owner must be attached.
If the electricity or water connection is in the applicant’s name (who is a tenant), then the rental/lease agreement alone is sufficient. No identity documents should be demanded.
If the property is in the name of the applicant’s spouse or relatives, a consent letter is required. If the water tax receipt or electricity bill has the relative’s name, those documents are also acceptable.
If all documents are in order, the registration certificate should be issued within 7 days.
If there are any discrepancies or doubts, officials must conduct a site inspection. The new RC must be issued within a month of application.
